BEVMARK is more than a collective of specialized industry consultants. After over three decades of service, we hold a special position with clients as trusted advisors. BEVMARK has a unique reputation. We work privately and confidentially as an extension of top management, in some ways as an alter-ego to executives with whom we regularly confer. We follow and study their businesses, think about and work to understand their operations, become experts on their affairs and particular issues. They rely upon us for outside and objective perspective. Because we work across industries and are not captive to single clients, we bring in depth insights that debunk easy and frequently wrong assumptions. Our role is to challenge and find answers, as an extension.

BEVMARK has assisted clients in a capacity beyond consulting, contributing our teams to actively join with client management in implementation and execution of strategies. For instance, a BEVMARK team advising Quaker Oats CEO actively managed the Snapple brand during a transitional period. We have quietly conducted private merger and acquisition negotiations with and for CEO’s. For investment clients we have performed in field executive interviews and management audits of target companies. We have supplied valuations, participated in transaction discussions, and conducted due diligence.

We regularly evaluate strategic planning, production, marketing and sales matters. We advise on the strategic implications and consequences of financial and legal matters.

A primary function of BEVMARK is finance. We work with CEO’s, CFO’s, merger and acquisition teams and in house counsel to analyze transactions. We monitor the consumer and financial markets and appraise balance sheets, market values, opportunity and risk. We have conferred and advised on deals involving among others Coca-Cola, PepsiCo, Dr. Pepper, Quaker Oats, Cadbury-Schweppes, Kraft, Hansen Natural, Mars, Tata, SuperValu, Bacardi, Miller Brewing, Anheuser Busch, Heineken, Pernod Ricard, Cott, Swedish and Russian vodka ventures, and National Beverage.

Our financial specialists meet with clients to analyze economics. We study and model performance and cash flow. We supply leading business media expert commentary and analysis of quarterly results.

A substantial part of our team’s financial practice involves our advisory service for the investment community. We counsel investment banks; equity, hedge and pension funds; brokerages; venture capital; and middle market firms.

BEVMARK has advised all ten of the top ten 2010 M&A investment banks: Goldman Sachs, J.P. Morgan Chase, Morgan Stanley, Credit Suisse, Bank of America/Merrill Lynch, Deutsche Bank, Barclays, UBS, Citigroup and Lazard.

We have counseled the majority of top ten 2010 private equity funds: TPG, Goldman Sachs Capital Partners, KKR, Apollo, Bain, Blackstone, Warburg Pincus. We have consulted on investments with over 75 different hedge funds.

We have analyzed economics and testified on financial issues in antitrust proceedings and approval petitions before the FTC. We have advised the DOJ, BATF and GAO on food and beverage industry economics.

Our team constructs damage models in law suits.

We have worked as an agent for the U.S. Bankruptcy Court, to determine value and sell assets.

We provide financial advice to governmental agencies and bureaus, both U.S. and foreign, on trade, taxation and regulatory economics.

BEVMARK works extensively in the legal sector, as a litigation consultant advising lawyers on industry-related matters and strategy for cases. We supply expert witness testimony in Federal and State Courts. BEVMARK’s expert witness service has been positively chronicled in American Lawyer Magazine.

BEVMARK has been admitted as an expert on antitrust and its opinions cited in judgments in proceedings before the U.S. Federal Trade Commission. We have advised on antitrust matters and the Competition Law in the European Union, as well as on legal and registration matters in China. We have consulted on retainer to the U.S. Department of Justice, as well as serving as an expert witness and researcher for the DOJ. We have worked on behalf of clients with State authorities as the California ABC.

We have worked as an agent of the U.S. Bankruptcy Court.

We advise General Counsels and in house lawyers of some of our largest clients, as well as their assigned outside law firms.

Our work encompasses virtually all issues involving legal matters in the food and beverage industries including antitrust, unfair competition, Lanham Act, Intellectual Property, regulations, legislation, approvals, contractual disputes, terminations, bankruptcy, class action suits, product liability, and damage analysis.

We have worked with many of the leading law firms including Skadden Arps, Fulbright & Jaworksi, White & Case, Kirkland & Ellis, The Rose Law Firm, Simpson Thatcher, Severson & Werson, Arnold & Porter, Milbank Tweed, Proskauer Rose, Littler Mendelson, Milberg Weiss, McDermott Will & Emery, Lawson Lundell, Kaufman & Canoles, Hale & Dorr, Howery, Knobbe Martens, Clemons & Knock, Lewis Brisbois, Hagen Berman, Nixon Peabody, Munger Tolles, Pattersons Bernap, Allen Ruby, Cowen Liebowitz and Brooks Kushman.

BEVMARK monitors the food and beverage industries. We track, analyze, study and advise on developments for leading competitors. Professional investors regularly employ us for insights and perspectives on performance and valuations.

We conduct field research for our clients. Corporate clients and governments retain us to do both qualitative and quantitative research. A separate division of BEVMARK, BEVMARK RESEARCH, does in field work to assess brands and competition; purchasing psychology and motivations; trends, etc. Our trained researchers and behavioral experts survey markets, often in a dozen cities per assignment, interviewing consumers and the trade at point of purchase and consumption.

Our field work led to the creation of BEVTECH in 1995. BEVTECH is a division of BEVMARK devoted to applying new and innovative technologies in the retail marketplace. Our focus is on the development of interactive and digital communication technologies designed to affect and influence consumer purchasing behavior as it occurs. Our work with patents and engineers has rapidly accelerated in recent years as we assist in the altering and reshaping of the consumer retail buying environment via Real Imaging Three D Technology, smart phone applications, sight/sound/touch/smell design and other cutting edge technologies to create a more alive and stimulating sales milieu.

BEVMARK provides services in all major world markets. Our consultants live in countries as

  • U.S.,
  • China,
  • India,
  • Germany,
  • France,
  • Brazil

Teams work and travel in the markets in which we assist.

Recently BEVMARK has decentralized, condensing New York, San Francisco, Los Angeles, Washington and Paris offices into a central California headquarter office. This was done for two reasons: to reduce fixed overhead that had to be charged back to clients and in recognition of the fact that our consultants now primarily work and communicate collaboratively online, by webcast and via data/document sharing. And of course, we travel to clients to confer and deliver results.

Our practice is essentially an "intelligence service." We find it more effective and efficient for our Consultants to work in the field and their personal offices as opposed to siting in fixed central offices.
